The Subsidiary Committee

The Subsidiary Committee of the Meeting of States Parties to the 1970 Convention is made up of representatives from  18 States Parties (3 per regional group). The election of the Committee follows the principles of geographic representation and fair rotation. The members of the Committee are elected for a period of four years. Every two years, the Meeting of States Parties renews half of the members of the Committee. A member of the Committee cannot be elected for two consecutive terms.
The functions of the Subsidiary Committee are:

  • promoting the aims of the Convention;
  • reviewing of national reports submitted to the General Conference by States Parties to the Convention;
  • preparing and submitting to the Meeting of States Parties recommendations and guidelines that can contribute to the implementation of the Convention;
  • identify problematic situations resulting from the implementation of the Convention, including matters relating to the protection and return of cultural property;
  • establishing and maintaining coordination with the “Return-Restitution” Committee in connection with capacity-building measures to fight the illicit trafficking of cultural property;
  • informing the Meeting of States Parties of the activities that have been implemented.

Twelfth Session of the Subsidiary Committee (12.SC)

The Twelfth Session of the Subsidiary Committee of the Meeting of States Parties to the 1970 Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property, will be held on 27 and 28 May 2024.

Extraordinary session of the Subsidiary Committee

Room IX, UNESCO Headquarters in Paris - 18 May 2015, 9 a.m. to 10 a.m.

As stated in the Rules of Procedure of the Subsidiary Committee, one of its functions is to report to the Meeting of States Parties on the activities it has carried out. The Subsidiary Committee agreed in its Second session to hold an Extraordinary Session (Decision 2.SC 6 point 3).

During the Extraordinary session, the Committee will approve the Report and Road map of the Committee, prior to the submission of these documents to the Third Meeting of States Parties (18 to 20 May 2015).

First session of the Subsidiary Committee (1.SC)

Election and first session

The Subsidiary Committee has been elected by the Extraordinary meeting of the States Parties to the 1970 Convention which took place on 1st July 2013.

The first session of the Subsidiary Committee took place from 2 to 3 July 2013 at UNESCO Headquarters.

Since then, this Committee has been convened every year.

Informal Reflection Group Meeting

The Informal Reflection Group (IRG) was established by the Subsidiary Committee of the Meeting of States Parties to the 1970 Convention, at its Third session on 30 September 2015 (Decision 3.SC 9).

The second meeting of the IRG met at UNESCO Headquarters in room IX.

1st Meeting - June 2016

3 to 5 June 2016, Delphi, Greece

Members and Observers of the Committee met in Delphi, Greece, to review the outcomes of the 30 March 2016 Roundtable “The movement of cultural property in 2016: regulation, international cooperation and diligence of professionals for cultural heritage protection”, organized within the framework of several decisions taken at its last session, with the goal to promote the dialogue between different actors, including strengthening cooperation with art market professionals.

Moreover, the Group discussed about establishing draft procedures to claim protected cultural property on sale at auction and exchange good practices. The Group also dealt with the simplification and standardization of the procedures in cases of theft, seizure or restitution, as well as a review of the national reports on the implementation of the 1970 Convention which were prepared at the last Session of the Subsidiary Committee.

This meeting is generously hosted by the Government of Greece with the support of the People’s Republic of China.

Informal Working Group (IWG) Meetings

The informal working group was created following the decision 1.SC 4 on the 1st session of the Subsidiary Committee, and is composed of all 18 Members of the Subsidiary Committee under the coordination of the Chairperson of this Committee to work on the Draft Guidelines for the implementation of the 1970 Convention and on other relevant items in preparation of the next Subsidiary Committee session. The final results of this informal working group will be submitted to the next ordinary session of the Subsidiary Committee (30 June to 2 July 2014) for possible adoption.

4th IWG - 28-30 April 2014

The Informal Working Group will meet to consider the fourth draft of the Operational Guidelines for the implementation of the 1970 Convention and related written inputs, on 28-30 April 2014, in Sofia, Bulgaria. This meeting will be generously hosted by the Government of Bulgaria. Simultaneous interpretation will be provided in English and French. Both Member and Observer States are invited to attend this meeting. The Informal Working Group hopes to reach a consensus on the draft of the Operational Guidelines in Bulgaria, in order to submit it for the consideration during the next ordinary session of the Subsidiary Committee.

3rd IWG - 17-18 March 2014

This working group met for the third time on 17-18 March 2014 at UNESCO Headquarters. During this meeting, the group considered the 3rd Draft of the Operational Guidelines and related written inputs submitted by Member and Observer States, as well as considered ways and means to fulfill the other functions of the Subsidiary Committee to the 1970 Convention.

2nd IWG - 17-18 February 2014

This working group met for the second time on 17-18 February 2014 at UNESCO Headquarters (room XIV). Discussions centered around the Operational Guidelines and on the topics raised by the Chairperson.

1st IWG - 26 November 2013

This meeting was held to discuss the methodology that the Informal Working Group (IWG) will follow to fulfill its duties over the coming sessions. The meeting also was an opportunity for the Chairperson of the Subsidiary Committee to provide an information update.

First Joint Meeting of the Bureaus

First Joint Meeting of the Bureaus: Bureau for the Protection of Cultural Property in the Event of Armed Conflict and Bureau of the Subsidiary Committee of the Meeting of States Parties to the 1970 Convention

 

In accordance with Decision 3.SC/4.3, adopted at the Third Session of the Subsidiary Committee to the Meeting of States Parties to the 1970 Convention (UNESCO Headquarters, 28 - 30 September 2015), a joint meeting of the two Bureaus (Bureau of the Committee for the Protection of Cultural Property in the Event of Armed Conflict and Bureau of the Subsidiary Committee of the Meeting of States Parties to the 1970 Convention) took place for the first time on 7 December 2015 at UNESCO Headquarters, room XI.  

The joint meeting was opened by the Director of the Division for Heritage after which the participating member states exchanged information on the destruction of cultural heritage during armed conflict and the illicit trafficking of cultural property, specifically in Iraq and Syria. The second half of the meeting was devoted to a productive exchange on the organization of awareness-raising and training of the military, police force and custom officials in times of armed conflict for the protection of cultural heritage and against its illicit trafficking.  

In the framework of the World Heritage Committee meeting in Bonn (June 2015) and subsequent adoption of the Joint Statement by the Chairpersons of the six UNESCO Cultural Conventions Committees, the members of the Bureaus agreed to encourage the Director-General of UNESCO to organize a meeting with the six Chairpersons during the fourth session of the Subsidiary Committee to the Meeting of States Parties to the 1970 Convention.
